at Linucare

Welcome to Linucare. These terms of service apply to the use of the services that Linucare, CVR number 44214946, ("Linucare" or "we") offers you through our app "Linucare" ("the App").

Please review the terms of service carefully before you start using the App. You must accept the terms of service in order to use the App.

1. General

The App is an application-based service where you can obtain help in acute situations. When the App is used, close contacts or people nearby will be notified about your situation.

2. Your Account and Use of the App

To use the App you must create a user account. When you register your account you will be asked to provide certain personal information. You must then confirm that the information is correct and up to date. This is your responsibility for as long as you hold a user account. Information about how we process personal data can be found under "privacy policy".

Your user account is personal and you are responsible for ensuring that no one else uses it. You are responsible for all use of the App that goes through your user account.

3. Our Delivery of the App

Linucare is still developing the App and may, in whole or in part, update, modify, or temporarily or permanently shut down the App or parts of it (such as, but not limited to, features and available services). It may be necessary to carry out work that affects the App. The App may from time to time, in whole or in part, be unavailable or not function satisfactorily due to scheduled or unscheduled maintenance, malfunctions or other circumstances.

Linucare has the right to close your account and deregister you from the App with immediate effect if you misuse the App, cause harm or disruption to the App or to us, or if you otherwise breach these terms of service. If your account has been closed pursuant to this clause, you do not have the right to re-register or create a new account without special permission from Linucare.

4. Payments

Free features: The Linucare app can be downloaded and used free of charge to the extent this is indicated for the relevant solution, account or subscription type.

Paid features: Certain features, subscriptions, products or services may require payment. Applicable prices, features and terms will at all times be shown on the relevant product page, subscription page, order confirmation and/or in the app.

Payment and renewal: If you sign up for a paid solution, you agree to pay the applicable prices and any ongoing subscriptions in accordance with the selected solution. Any ongoing subscriptions renew automatically unless otherwise stated at the time of purchase or cancelled in accordance with the applicable terms.

Changes: Linucare reserves the right to change prices, features and terms with prior notice where required or relevant.

5. Your Responsibility

You are responsible for ensuring that your account is used in accordance with these terms of service, other terms set out in the App and applicable law at all times.

If you breach these terms of service or applicable law, or if you use the App in an unlawful or unauthorised manner, you are obliged to compensate and indemnify Linucare against all damage caused thereby.

Important!

When using the App, you are responsible for having access to the internet, Bluetooth and location services, and for ensuring that the phone does not have power-saving mode activated. You should also keep the app updated.

6. Our Responsibility

We strive to offer the App continuously and with stability. However, the App and website are offered as-is and without obligations or warranties of any kind. Linucare does not accept responsibility for any damage that may arise because you cannot access the App or the App's functionality. We reserve the right to update, revise, or temporarily or permanently discontinue offering the App. We do not accept responsibility for content on websites linked to or from the App or website.

7. Termination of Terms of Service / Account Closure

These terms of service apply for as long as you have a user account. If you wish not to be bound by the terms of service, you must close your account in accordance with the instructions in the account.

If you close the account, we will promptly delete all available information about you, with the exception of information that we are legally obliged to retain.

8. Intellectual Property Rights

Ownership, copyright and all other rights to the App, Linucare's trademark, company and website, and all documents used and/or offered by Linucare on the website and in the Service, belong exclusively to Linucare (or in some cases our licensor). All copying, modification, transfer and/or other use of Linucare's material that is not expressly permitted under the terms of service or occasional instructions is prohibited. You acknowledge and accept that you are aware that unauthorised use of our intellectual property rights, in addition to a breach of the terms of service, may be criminal.

Ownership and copyright of any image and video material made available by you belongs to you. However, Linucare has the right to use image and video material in order to provide you with the App. This means, among other things, that Linucare has the right to store and copy, and to forward image and video material to another professional, e.g. in connection with a referral. We do not use image or video material for any purpose other than to provide the App.

9. Processing of Your Personal Information

Your privacy and personal information are important to us. All personal information you provide to us is processed in accordance with our privacy policy. It explains what information we collect, how and why we collect, store, use and share the information. It also sets out your rights regarding personal information and how to contact us if you have questions or complaints regarding the use of your personal information. 10. Changes to the Terms

Linucare may change the terms of service. In the event of a change, we will publish the new terms of service on the website and in the App and inform you of this via the email address you have provided in the App.

If you do not accept one or more changes to the terms of service, you must stop using the App by deregistering your account, or contact us with a request to close the account.

11. Disputes

These Terms are governed by Danish law. The courts in Denmark, or the country where you reside, have exclusive jurisdiction to determine any claim or dispute arising under these Terms. If you live in the EU, the European Commission offers an online platform for dispute resolution, which you can access here: https://ec.europa.eu/consumer/odr.

Privacy Policy

We only collect personal data in cases where this would be relevant to us, and we will only collect personal data if it is relevant to your activity with Linucare.

When collecting, processing and using your personal data, we always comply with all relevant statutory provisions.

We will only retain your personal data for as long as we are subject to a legal obligation to do so, or for as long as it is relevant for the purpose for which it was collected.

Information We Collect

We may collect information such as name, email address, postal address, delivery address (if different from postal address), telephone number and payment information.

Linucare collects and processes your personal data when you do the following:

  • Visit our website
  • Complete a purchase of our products
  • Use our service
  • Create an account
  • Subscribe to our newsletter
  • Review our website
  • Send us questions, complaints or feedback

Location

Linucare sends alerts to the nearest helpers. In order to calculate which helpers are closest, we need location data. The location is based on e.g. satellite, WiFi and mobile network.

Legal Basis and Purposes

Your personal data will be processed for the following purposes:

  • Administration of the assistance scheme and the app: For use in administering the assistance scheme and the app, including registering you as a user of the Linucare app, and assigning a password, as well as providing relevant app support etc.
  • Request for help: Location data is recorded via the mobile phone. Data is processed for the purpose of finding helpers who are located near your current location.
  • Alerting potential helpers: Location data is recorded via the mobile phone. Data is processed for the purpose of calculating whether your current location means you are a potential helper in an emergency.
  • Communication: Ongoing communication is essential to ensure that the scheme works as it should. It may be relevant to communicate before, during and after a task has been carried out. Communication may relate, for example, to responding to specific requests from you and informing you about news and changes in the assistance scheme.
  • Quality development: Your data will be used for the quality development of the app as well as analysis, evaluation and ongoing development of the assistance scheme, to ensure that it always works as optimally as possible.
  • Statistics: We continuously compile statistics on helpers and in relation to the assistance scheme in general.

Data You Have Provided When Registering in the App

  • Name
  • Email address
  • Phone number
  • Year of birth
  • Username and password

Information That Is Generated and/or Received on an Ongoing Basis

  • Time of registration
  • Time of app update
  • Information about your ongoing geographical location, information about the tasks you may have participated in, including time records, date and time of alert and acceptance/rejection of alarm.

Legal Basis for Use of Information

Article 6(1)(a) of the General Data Protection Regulation (consent) for use in administering Linucare and the app. Consent is obtained when you register in the app.

  • We process your location data based on your consent, so that we can contact you if someone in your groups needs emergency assistance.
  • We process your location data based on your consent, so that we can guide others in your group to you if you activate the alarm.

Deletion

We only process the information for the stated purposes, and they are deleted when they are no longer necessary for those purposes.

Your Rights

As the data subject, you have a number of rights which we must ensure are fulfilled at all times. You have the right to request the following from us:

  • To access and have your personal data corrected/amended
  • To have personal data deleted

You also have the right to object to the processing of your personal data, and you have the right to lodge a complaint with a data protection authority.

You have the right to lodge a complaint with the Danish Data Protection Authority (Datatilsynet) if you are dissatisfied with the way we process your personal data. You can see the Data Protection Authority's contact information at datatilsynet.dk.
